1. Acceptance of These Terms
In plain English: These Terms are a binding contract between you and Overland Bound. You agree to them when you create an account, buy a membership, or use our apps.
These Terms of Service (“Terms”) govern your access to and use of the websites, forums, mobile applications, maps, and services operated by Overland Bound, Inc. (collectively, the “Platform”).
You accept these Terms when you create an account, purchase a membership, download or use one of our mobile applications, or otherwise use the Platform. If you do not agree to these Terms, do not use the Platform.
If you accept these Terms on behalf of a company, club, or other organization, you represent that you have authority to bind that organization, and “you” refers to that organization.
These Terms incorporate by reference our Privacy Policy, our Founding Principles, and our Community Guidelines. Together, these documents form the complete agreement between you and Overland Bound.
2. Who We Are

References to “Overland Bound,” “we,” “us,” and “our” mean Overland Bound, Inc. References to “you” and “your” mean the person or organization using the Platform.
3. Eligibility
In plain English: You have to be 18 to have an account. Some people are not allowed to use the Platform at all.
3.1 Age
You must be at least 18 years old to create an account, purchase a membership, or otherwise use the Platform. The Platform is not directed to children, and we do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will delete that information and terminate the account.
3.2 Prohibited Persons
You may not create an account or use the Platform if:
- You are a convicted sex offender, or you are required to register as a sex offender in any jurisdiction;
- Your account has previously been terminated by Overland Bound, unless we have expressly reinstated your access in writing;
- You are barred from receiving our services under any applicable law, sanctions program, or export control regulation.
3.3 How We Enforce Section 3.2
Overland Bound does not conduct background checks and does not screen members for criminal history. We rely on reports from our community.
If you believe a member is prohibited from using the Platform under Section 3.2, contact us at support@overlandbound.com with the subject line “Eligibility Report” and include a direct link to that person’s entry in an official national or state sex offender registry. We do not accept reports based on third-party websites that aggregate or republish public records, and we do not accept reports based on allegation, rumor, or unverified accusation.
We review credible reports and may remove accounts at our sole discretion. We are not obligated to investigate any report, to explain any decision, or to notify any party of the outcome.
4. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.
You may hold only one account unless we authorize otherwise in writing. You may not sell, transfer, or share your account with anyone else. You may not register on behalf of a company, club, brand, or other organization, or represent yourself as a person you are not, without our prior written permission.
Member numbers and member emblems are issued to an individual member and are not transferable.
5. Membership, Billing, and Automatic Renewal
In plain English: Memberships renew automatically until you cancel. You can cancel any time, and we will tell you how.
5.1 Membership
Overland Bound offers paid memberships that provide access to member features of the Platform. Membership benefits, features, and pricing are described at the point of purchase and may change over time. We will give you notice before a change that materially reduces the benefits of a membership term you have already paid for.
5.2 Automatic Renewal
Your membership renews automatically. Unless you cancel, your membership will automatically renew at the end of each membership term, and the payment method on file will be charged the then-current renewal price. The length of the term and the renewal price are disclosed to you before you complete your purchase, and again in the confirmation we send after purchase.
5.3 How to Cancel
You may cancel at any time, and cancellation takes effect at the end of the current paid term. You will retain access to member features until that term ends. How you cancel depends on where you purchased:
- Our web store (store.overlandbound.com) — In your account settings on the web store, or by contacting us at support@overlandbound.com. You may cancel through the same method you used to subscribe.
- Apple App Store (in-app purchase) — In your Apple ID subscription settings. Apple controls billing and cancellation for these purchases; we cannot cancel or refund them on your behalf.
- Google Play (in-app purchase) — In your Google Play subscription settings. Google controls billing and cancellation for these purchases; we cannot cancel or refund them on your behalf.
To avoid being charged for the next term, cancel at least 24 hours before the end of your current term.
5.4 Price Changes
If we change the renewal price, we will notify you in advance of the renewal and you will have the opportunity to cancel before the new price takes effect.
6. Member Content and License
In plain English: You keep ownership of what you post. You give us permission to use it, including in mapping products and partnerships.
6.1 Your Content
“Member Content” means anything you submit, post, or upload to the Platform, including forum posts, messages, photographs, videos, trip reports, reviews, comments, points of interest, waypoints, GPX and other track or route data, trail descriptions, and profile information.
You retain ownership of your Member Content.
6.2 License You Grant Us
By submitting Member Content, you grant Overland Bound a worldwide, non-exclusive, perpetual, irrevocable, transferable, royalty-free license to host, store, reproduce, modify, adapt, translate, create derivative works from, publish, publicly display, publicly perform, and distribute your Member Content on and in connection with the Platform, and in marketing, promotional, and editorial materials for Overland Bound.
6.3 Geographic Content
“Geographic Content” means the subset of Member Content consisting of points of interest, waypoints, GPX and other track or route data, trail descriptions, trail conditions, and associated ratings and metadata — but not your photographs, forum posts, messages, or profile information.
For Geographic Content only, the license in Section 6.2 also includes the right to sublicense, and to use that content in data products, mapping products, and services we offer or develop, including through licensing, distribution, or integration arrangements with third parties such as vehicle manufacturers and mapping providers.
This is how community trail knowledge reaches a wider audience and how partnerships help fund the Platform. It applies to trail and location data only.
6.4 Survival and Moral Rights
The licenses in Sections 6.2 and 6.3 survive termination of your account and of these Terms. To the extent permitted by law, you waive any moral rights you may have in your Member Content, and you waive any right to inspect or approve how we use it.
6.5 Your Representations
You represent that you own or have all necessary rights to your Member Content, and that it does not infringe anyone’s intellectual property, privacy, or publicity rights.
6.6 Our Discretion
We may review, refuse, edit, or remove any Member Content at any time, for any reason or no reason, without notice. We are not obligated to review Member Content, and we do not endorse any opinion expressed in it. Member Content may be sent to third-party services for spam detection, safety review, or verification. Do not submit anything you consider private or confidential.
7. Prohibited Conduct
You agree not to:

- Post content that is defamatory, abusive, harassing, hateful, threatening, obscene, sexually explicit, or that promotes violence or discrimination;
- Post content that infringes anyone’s intellectual property, privacy, or publicity rights;
- Post another person’s private information without their consent;
- Impersonate any person or organization, or misrepresent your affiliation with any person or organization;
- Encourage or facilitate any unlawful activity, including trespass on private or restricted land;
- Post content involving the sexual exploitation of minors. We report such content to the National Center for Missing & Exploited Children and to law enforcement.
Commercial activity
- Advertise, sell, or promote products or services, or link to products for your own commercial benefit, without our written permission. Business inquiries go to info@overlandbound.com;
- Use the Platform to recruit members to social groups, forums, or communities outside the Platform;
- Register or operate an account on behalf of a company, club, or organization without our written permission.
Technical
- Scrape, crawl, harvest, or use automated means to extract data from the Platform;
- Access the Platform or our APIs through any interface other than those we provide, or exceed rate limits we establish;
- Reverse engineer, decompile, or disassemble any part of the Platform;
- Circumvent, disable, or interfere with security features, geographic restrictions, access controls, or bot detection;
- Use proxies, VPNs, or other means to disguise the origin of your traffic in order to evade our access controls;
- Introduce malware, conduct denial-of-service attacks, or conduct security testing or penetration testing without our prior written authorization;
- Copy, extract, or create a competing or derivative database from our map data, trail data, or member data.
We may investigate suspected violations and cooperate with law enforcement.
8. Navigation, Map Data, and Trail Information
In plain English: Our maps are a planning aid, not a guarantee. Verify everything before you go, and do not rely on them in an emergency.
This section is important. Please read it carefully.
8.1 Nature of the Data
The Platform includes maps, trail data, points of interest, route information, land management boundaries, and member-contributed geographic content (collectively, “Map Data”). Map Data is compiled from a range of sources, including public agency datasets, commercial data providers, and contributions from members.
Map Data is provided for general planning and reference purposes only. It is not a substitute for official maps, current land management information, or your own judgment.
8.2 Map Data May Be Wrong
You acknowledge and agree that Map Data:
- May be inaccurate, incomplete, outdated, or wrong;
- May have been obtained from public agency sources at a point in time and may not reflect current conditions, boundaries, or designations;
- May not reflect seasonal closures, emergency closures, fire restrictions, weather events, washouts, gates, permit requirements, or changes in land ownership;
- May show routes that cross private property, tribal land, or areas where public access is restricted or prohibited;
- May show routes that are impassable, unmaintained, or unsafe for your vehicle;
- May misrepresent trail difficulty, surface conditions, water crossings, or elevation.
Any review, moderation, or curation we apply to member-contributed content is not verification. We do not independently confirm the accuracy of Map Data, and no review process should be understood as a warranty that any route, point of interest, or trail description is accurate, current, legal to access, or safe.
8.3 Your Responsibilities
Before you travel, you are solely responsible for:
- Confirming current land status, access rights, closures, and permit requirements with the relevant land management agency;
- Confirming that you have legal permission to access any route or destination;
- Confirming that conditions and terrain are within the capability of your vehicle, your equipment, and your experience;
- Carrying appropriate navigation, communication, recovery, and emergency equipment;
- Understanding and following applicable laws, regulations, and responsible-use principles.
8.4 Not for Emergency Use
The Platform is not an emergency service and must not be relied upon in an emergency. Do not depend on the Platform for emergency navigation, emergency communication, or rescue. Cellular and data coverage is unavailable across much of the terrain our members travel. GPS positioning may be inaccurate or unavailable. Features that depend on connectivity will not function without it.
Carry a satellite communicator or personal locator beacon and an independent means of navigation.
8.5 Assumption of Risk
Backcountry and off-highway travel carries inherent risks, including vehicle damage, property damage, injury, disability, and death. These risks cannot be eliminated. By using Map Data to plan or undertake travel, you knowingly and voluntarily assume all such risks, and you accept full responsibility for your decisions, your route selection, and your safety and the safety of anyone traveling with you.
9. Rally Point Events, Crews, and Member-Organized Trips
In plain English: Members organize their own trips. We provide the tools; we are not the organizer.
9.1 Our Role
Rally Point and Crews are tools that allow members to plan trips, discover events, and coordinate with one another. Except for events we expressly identify in writing as officially organized and hosted by Overland Bound, we are a platform provider, not an event organizer.
We do not organize, lead, supervise, inspect, permit, insure, or control member-created trips or events. We do not vet organizers or participants. We do not verify that any organizer holds required permits, insurance, or land use authorization.
9.2 Organizers
If you create or lead a trip or event, you are solely responsible for it — including obtaining any required permits and authorizations, complying with applicable law and land use rules, and for your own conduct and decisions. You are not an agent, employee, representative, or partner of Overland Bound, and you may not represent that Overland Bound sponsors, endorses, insures, or supervises your event.
This applies equally to Ambassadors and other volunteer members. Volunteer roles are recognitions within our community and do not confer authority to act on behalf of Overland Bound.
9.3 Participants
You participate in trips and events at your own risk. You acknowledge that these activities carry inherent dangers, including the risk of illness, property damage, bodily injury, disability, and death, and you freely choose to assume those risks.
9.4 Interactions With Other Members
You are solely responsible for your interactions with other members, online and in person. We do not conduct background checks on members. Exercise the same caution you would with anyone you meet through any other community.
10. Copyright and DMCA
In plain English: If someone posts your copyrighted work without permission, tell us and we will take it down.
We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act.
10.1 Filing a Notice
If you believe your copyrighted work has been used on the Platform in a way that constitutes infringement, send a written notice to our Designated Agent containing:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to be infringed;
- Identification of the material claimed to be infringing and information reasonably sufficient to let us locate it (a URL is best);
- Your name, mailing address, telephone number, and email address;
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

10.2 Counter-Notification
If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notification to the Designated Agent containing your signature, identification of the removed material and its former location, a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification, your name, address, and telephone number, and your consent to the jurisdiction of the federal court for your judicial district (or, if outside the United States, for the Eastern District of California), and that you will accept service of process from the party who filed the notice.
10.3 Repeat Infringers
We terminate the accounts of repeat infringers in appropriate circumstances.
11. Third-Party Platforms and Services
The Platform may contain links to third-party websites, and members frequently organize using third-party tools such as messaging apps, social networks, and chat servers that are not operated by us.
We do not control, endorse, monitor, or take responsibility for any third-party website, service, platform, group, or the conduct that occurs there — including groups that reference Overland Bound, use our name, or are organized by our members. Your use of any third-party service is governed by that service’s terms, and is at your own risk.
You may not create a link to the Platform from another website or document without our prior written consent.
12. Store Orders, Shipping, Returns, and Refunds
These terms apply to physical goods purchased from our store. Membership purchases are governed by Section 5.
12.1 Shipping
We ship within the continental United States, Alaska, Hawaii, APO/FPO addresses, U.S. territories, and internationally. International orders may incur additional charges and extended delivery times, and you are responsible for any customs duties, taxes, or import fees.
Orders ship within five business days unless an expedited option is selected. Custom and personalized items, including duplicate member emblems, are subject to manufacturing timelines and may take longer.
Shipments are sent via USPS, DHL, or FedEx. Tracking information is provided by email once your order ships.
12.2 Returns
Products may be returned within 30 days of purchase if they are in original condition and original packaging.
Custom and personalized products, including member emblems, are not returnable or refundable.
Sale items may be returned under this policy.

12.3 Shipping Charges on Returns
Original shipping charges are not refundable, and you are responsible for the cost of shipping a returned product to us — except where the return is the result of our error or a defective product, in which case we cover it.
12.4 Damaged or Incorrect Items
If you receive a damaged, defective, or incorrect product, contact us within 30 days and we will make it right at no cost to you.

13. Termination and Suspension
13.1 By You
You may stop using the Platform at any time. To close your account, contact us. Closing your account does not automatically cancel a paid membership — see Section 5.3.
13.2 By Us
We may suspend or terminate your account, remove your content, or restrict your access at any time, with or without notice, including if we believe you have violated these Terms, if you are a prohibited person under Section 3.2, if your conduct harms the community or the Platform, or if we discontinue the Platform.
13.3 Effect on a Paid Membership
If we terminate your membership because you violated these Terms, no refund is provided. If we terminate for any other reason, we will refund the unused portion of your current term on a pro-rata basis. Refunds for purchases made through the Apple App Store or Google Play are controlled by Apple and Google under their own policies.
13.4 Survival
Sections 6.2, 6.3, and 6.4 (licenses), 8 (map data), 14 (release), 15 (indemnification), 16 (warranties), 17 (liability), 18 (disputes), and 21 (general) survive termination.
14. Release
In plain English: You agree not to hold us responsible for what other members do, for events, or for your dealings with third parties.
To the fullest extent permitted by law, you release Overland Bound and its officers, directors, shareholders, agents, employees, consultants, parent, affiliates, subsidiaries, sponsors, and partners (the “Overland Bound Parties”) from all claims, demands, and damages, direct and consequential, arising out of or connected with:
- any transaction with a third party;
- your interactions with other members, online or in person;
- any Rally Point event, Crew activity, or member-organized trip;
- any third-party website, platform, group, or service, including those referenced in Section 11;
- your reliance on Map Data or any other information on the Platform;
- any travel, route, or destination you undertake.
To the fullest extent permitted by law, you also release organizers from claims based on an organizer’s negligence arising out of or connected with their content, a member, or an event.
You waive California Civil Code Section 1542 and any similar provision of any other jurisdiction, which reads: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
Some jurisdictions do not permit this release, so it may not apply to you.
15. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless the Overland Bound Parties from any third-party claims, liability, damages, costs, or demands, including reasonable attorneys’ fees, arising from:
- your use of the Platform, including any content, products, or services obtained through it;
- your violation of these Terms;
- your infringement of any intellectual property or other right of any person or entity;
- your violation of any applicable law or regulation;
- any trip, event, or activity you organize, lead, or participate in;
- your Member Content.
You agree to cooperate in the defense of any such claim. We retain the exclusive right to settle, compromise, and pay any claim, and to assume the defense and control of any claim.
16. Disclaimer of Warranties
YOU EXPRESSLY AGREE THAT YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK. THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
OVERLAND BOUND EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AS TO THE OPERATION OF THE PLATFORM OR THE INFORMATION, CONTENT, MAP DATA, MATERIALS, OR PRODUCTS INCLUDED IN IT.
WE MAKE NO WARRANTY THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS, OR THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. WE MAKE NO WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE PLATFORM, OR AS TO THE ACCURACY, CURRENCY, COMPLETENESS, RELIABILITY, OR USEFULNESS OF ANY INFORMATION OBTAINED THROUGH IT, INCLUDING MAP DATA, OR THAT DEFECTS WILL BE CORRECTED.
WE DO NOT CONTROL CONTENT, INFORMATION, PRODUCTS, OR SERVICES OFFERED BY ADVERTISERS, THIRD PARTIES, OR OTHER MEMBERS, AND WE ASSUME NO RESPONSIBILITY AND MAKE NO WARRANTY OR REPRESENTATION AS TO ANY OF IT.
YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, DEVICE, OR VEHICLE, OR ANY LOSS OF DATA, RESULTING FROM YOUR USE OF THE PLATFORM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
17. Limitation of Liability
YOU EXPRESSLY AGREE THAT THE OVERLAND BOUND PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, USE, DATA, OR OTHER INTANGIBLES, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM:
(I) USE OF OR INABILITY TO USE THE PLATFORM;
(II) COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES;
(III) ANY GOODS, SERVICES, OR CONTENT OBTAINED THROUGH THE PLATFORM, OR TRANSACTIONS ENTERED INTO THROUGH IT;
(IV) INACCURACY OF ANY INFORMATION OBTAINED FROM THE PLATFORM, INCLUDING MAP DATA, OR RELIANCE ON SUCH INFORMATION;
(V) ANY TRIP, ROUTE, EVENT, OR ACTIVITY;
(VI) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR ACCOUNT OR DATA;
(VII) THE CONDUCT OR SPEECH OF ANY OTHER PARTY ON OR THROUGH THE PLATFORM, INCLUDING ANY UNLAWFUL, HARASSING, DEFAMATORY, ABUSIVE, THREATENING, HARMFUL, VULGAR, OBSCENE, OR SEXUALLY EXPLICIT CONDUCT, OR ANY INFRINGEMENT OR VIOLATION OF YOUR RIGHTS BY ANY OTHER PARTY.
TO THE FULLEST EXTENT PERMITTED BY LAW, OVERLAND BOUND’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION IN CONNECTION WITH THE PLATFORM AND THESE TERMS SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID OVERLAND BOUND IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
18. Dispute Resolution and Governing Law
18.1 Governing Law
These Terms and any dispute arising out of them or your use of the Platform are governed by the laws of the State of California and applicable United States federal law, without regard to conflict of law principles.
18.2 Venue
You and Overland Bound agree that any dispute will be brought exclusively in the state or federal courts located in Placer County, California, and you consent to personal jurisdiction there.
18.3 Time Limit on Claims
Any claim arising out of these Terms or your use of the Platform must be filed within one year after the claim arose, or it is permanently barred, except where a longer period is required by law.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page and post the updated Terms on the Platform.
If we make a material change, we will provide reasonable advance notice — by email to the address associated with your account, by notice within the Platform, or both — before the change takes effect.
Your continued use of the Platform after the effective date of an update constitutes acceptance of the updated Terms. If you do not agree to an update, stop using the Platform and cancel your membership before the effective date.
20. Additional Terms for Mobile Applications
These terms apply to Overland Bound One and any other mobile application we offer.
20.1 License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the application on a device you own or control, for your personal, non-commercial use, subject to these Terms and to the applicable app store’s terms.
20.2 Apple App Store
If you obtained the application from the Apple App Store, the following apply:
- These Terms are between you and Overland Bound only, not with Apple. Apple is not responsible for the application or its content.
- Apple has no obligation to furnish any maintenance or support for the application.
- If the application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the application.
- Apple is not responsible for addressing any claim by you or a third party relating to the application, including product liability claims, claims that the application fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
- Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the application infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
20.3 Google Play
If you obtained the application from Google Play, your use is also subject to the Google Play Terms of Service. Refunds for purchases made through Google Play are handled by Google under its refund policies, and we cannot issue them on your behalf.
20.4 Location Permissions
Certain features require access to your device’s location, including background location, in order to function. You can control location permissions in your device settings, though some features will not work without them. How we handle location information is described in our Privacy Policy.
21. General Provisions
Entire Agreement. These Terms, together with the Privacy Policy, Founding Principles, and Community Guidelines, constitute the entire agreement between you and Overland Bound regarding the Platform, and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms or your account. We may assign these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.
Force Majeure. We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, fire, wildfire, flood, war, terrorism, civil unrest, labor disputes, government action, epidemic, network or infrastructure failure, or failure of third-party service providers.
No Agency. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and Overland Bound.
Third-Party Beneficiaries. Except as stated in Section 20.2, these Terms do not create any third-party beneficiary rights.
Headings and Summaries. Section headings and the plain-English summaries are for convenience only. Where a summary and the operative text differ, the operative text controls.
Notices. We may provide notice to you by email, by posting on the Platform, or through the application. You may provide notice to us at the address in Section 22.
